Identification

As used herein:

“we” “our” or “us” means Tony Roig Pickleball, LLC as well as its officers, agents, employees, independent contractors, representatives, and coaches.
“you” or “your” means any person who accesses our content, uses our coaching or otherwise interacts with us. By interacting with us, in any way, you are agreeing to these terms and conditions
Each of the above identifying terms are intended to be applied broadly.

Use of Website

Your use of the website and the information contained therein will be in compliance with all laws and is subject to these terms and conditions.

Content: Access, Use, and Disclaimers

You may access any free content on our site for your personal use, provided that such use complies with applicable laws and is subject to these terms and conditions.
Paid content may only be accessed with an appropriate login issued by us. Other access to our paid content is unauthorized.
We are not health care professionals and do not offer health care or medical advice. We also do not offer mental health care or mental health care advice. Any information we share is intended to be educational and informational and is not medical or mental health care advice. For medical or mental health advice, consult with a health care professional.

Camps and In-Person Experiences.

When electrolytes, snacks, lunch, or any other type of food or drink is provided or is part of an event, you remain responsible for monitoring any food allergens or other restrictions you may be under. We do not prepare the consumable and are not in a position to advise you of its contents. You will make such inquiries as you deem appropriate to your decision.
In no event will you look to us as responsible for any issue, damage, or loss from consuming food or drink at an event hosted or run by us.
From our perspective, you are welcome to bring your own food and drink items to ensure compliance with dietary restrictions. If a facility seeks to limit this, we will do our best to obtain their approval but cannot guarantee it.
We offer a money-back guarantee at our coaching experiences, including camps. The guarantee is limited to a maximum of the amount paid by you to us for the experience (including camp). In no event will we be responsible for reimbursing you for travel, lodging, food, or other expenses associated with attendance at an experience or camp. So that we may close our books, money-back guarantee requests must be made within thirty (30) days from the end of camp.
You may cancel a camp registration at any time. We do not charge a cancellation fee and will refund amounts paid, except as follows: (a) if you cancel within 7 days from the camp and the cancellation results in financial diminishment of the camp as a result of the cancellation, we may deduct the diminishment from the camp registration fee before refunding the balance, (b) we reserve the right to deduct payment processing fees (the same amount charged to us by the third party payment provider) and an administrative fee (max. $75) before issuing the refund.

Intellectual Property Rights

We reserve all intellectual property rights granted by statute or common law, including copyright and trademark laws. If you are interested in reproducing, republishing, copying, disseminating, or otherwise using any of our content, please reach out to us at [email protected].

Artificial Intelligence (AI)

While we are not AI-averse, we also believe in the power of human creativity and interaction. At this time we do not authorize the use of our content as part of any AI learning models.

Reservation of Rights

We will always do our best to welcome all persons and coach as many players as possible. While we respect the sonder of every person out there, we also respect our own sonder. Therefore, except as restricted by law: (a) we reserve the right to grant, deny, or condition access to any person to any of our coaching in any form, including online and in-person, (b) we reserve the right to conduct our coaching and content delivery in any way we deem the most appropriate to our mission.

Compliance with Laws

We endeavor in good faith to comply with all applicable laws and regulations. Every action we take, statement we make, or condition we outline shall be interpreted in such a manner as to be compliant with law. If necessary for such compliance, then the terms and conditions of service will be deemed amended, ab initio, to comply.

Liability

In no event will we be liable to you (directly or through indemnification) for any amount in excess of amounts paid by us to you. This is our maximum potential liability in any circumstance or event.
In no event will we be liable for any incidental damages, including lost profits, travel, lodging, food, or similar.

Dispute

In the super unlikely event that you and we end up in a disagreement, we will first seek to mediate the disagreement. If we cannot resolve the disagreement, then either of us can submit the disagreement to arbitration (which shall be the exclusive way of resolving the matter) before the AAA. Any mediation or arbitration will be conducted by electronic means to the maximum extent possible. If any in-person proceedings are required – or if court action is required – then it shall be held or instituted exclusively in the county where we have our principal place of business. Each you and us will be responsible for our own fees and costs in any mediation, arbitration, or other proceeding and shall not be reapportioned except by mutual agreement.

Amendment

We reserve the right to amend these terms and conditions at any time and in our discretion. Any transaction, interaction, use of website, access to content, or other action between you and us will be controlled by the terms and conditions in effect at that time and your engagement will constitute your agreement to the terms and conditions then in effect.
